چکیده
توسعه فناوری اطلاعات و ارتباطات منجربه تحول فعالیتهای اقتصادی ناظر بر کالا و خدمات و روابط دولت، کسبوکارها و شهروندان در این بستر گشته است که از آن تحتعنوان «اقتصاد دیجیتال» یاد میشود. زیستبوم این پارادایم نوظهور، مفروضات پیشین در فرایند سیاستگذاری عمومی حاکمبر اقتصاد سنتی را با تحولاتی روبهرو ساخته است که سیاستگذاری کیفری بهمنزله ابزاری همواره پیرو در اجرای سیاستهای بخشی نیز از آن منفک نیست. لذا، پرسش آن است که اقتصاد دیجیتال، چه استلزاماتی را در چرخه سیاستگذاری کیفری باخود بههمراه میآورد. پژوهش در این موضوع، باتوجه به تجربه سیاستگذاری اقتصاد دیجیتال در سالهای اخیر و اصول حقوق کیفری، این امر را آشکار میسازد که درپیشگرفتن سازمان، ساختار و سازوکارهای سیاستگذاری کیفری درباب نظمبخشی به فعالیتهای اقتصادی، بهروال اقتصاد سنتی و نادیدهانگاشتن بایستههای نوین حاکمبر این فضا، میتواند ناسازگار با اقتضائات اقتصاد دیجیتال جلوه نماید و با تأثیرگذاری مستقیم و نامطلوب بر خروجی این چرخه سیاستی، منجر به اخلال در این زیستبوم گشته و درنهایت، دولت را از بهرهمندی از این ابزار نوین قدرت در جهان بازدارد.
