دشواره‌‌ تعامل نص و واقعیت در برساخت سیاست جنایی ایران

چکیده

   این مقاله، به روش توصیفی- تحلیلی، برخی ریشه ­ها و جلوه­ های کژتابی معرفتی در نحوه سهم ­دهی به مهم­ترین نیروهای سازنده سیاست جنایی ایران– شرع، مدرنیسم و جامعه­ محوری (شرع، غرب، عرف)- را بازمی­ شناسد و نکاتی برای پیشگیری از درافتادن در دام اثبات­ گرایی حقوقی و نص­ گراییِ عقل­ گریز و جامعه‌ ستیز طرح می­کند. نه سیاست­ ها و مصالح حاکم بر فقه کیفری اسلام را می­توان عینا همان نظام سیاست جنایی اسلامی نامید، نه مدل ­های فرانسوی و آنگلوساکسونی و اروپای قاره­ ایِ جرم ­پاسخِ دولتی-جامعوی را می­توان در آیات و روایات، این­ همانی نمود. آرمان استغنا از تجارب جهانی و نظریه­ های جهان­ شمول و عظمت­ شعارِ عدالت کیفری سپری شد. باید میان نص فقه جزایی و واقعیتِ بزهکاری، دیالکتیکِ هم ­افزا برقرار کرد. این، آغاز راه برساخت «الگوی بومیِ سیاست جنایی» است.
