این مقاله، به روش توصیفی- تحلیلی، برخی ریشه ها و جلوه های کژتابی معرفتی در نحوه سهم دهی به مهمترین نیروهای سازنده سیاست جنایی ایران– شرع، مدرنیسم و جامعه محوری (شرع، غرب، عرف)- را بازمی شناسد و نکاتی برای پیشگیری از درافتادن در دام اثبات گرایی حقوقی و نص گراییِ عقل گریز و جامعه ستیز طرح میکند. نه سیاست ها و مصالح حاکم بر فقه کیفری اسلام را میتوان عینا همان نظام سیاست جنایی اسلامی نامید، نه مدل های فرانسوی و آنگلوساکسونی و اروپای قاره ایِ جرم پاسخِ دولتی-جامعوی را میتوان در آیات و روایات، این همانی نمود. آرمان استغنا از تجارب جهانی و نظریه های جهان شمول و عظمت شعارِ عدالت کیفری سپری شد. باید میان نص فقه جزایی و واقعیتِ بزهکاری، دیالکتیکِ هم افزا برقرار کرد. این، آغاز راه برساخت «الگوی بومیِ سیاست جنایی» است.
