تجاوز دولت ها به حقوق اساسی ملّت در قالب نقض حقوق بنیادین شهروندان و حوزه های مرتبط با بهداشت، سلامت، درمان و آموزش می‌تواند از مصادیق جرم دولتی محسوب شود. منظور از جرم دولتی، رفتارهای به ظاهر قانونی دولت ها است که متضمن نفع فردی و شخصی نبوده و قابلیّت اضرار عمومی دارد. این جرایم، علیرغم اهمیّت و قابلیّت ایجاد ضررهای جبران ناپذیر نسبت به شهروندان، در بسیاری از مصادیق عنوان مجرمانه پیدا نکرده و سیاستگذاری جنایی در خصوص آن با مشکل و مانع مواجه است. این نوشتار با توجه به ملزومات سیاستگذاری جنایی در خصوص جرایم دولتی، ابزارهای لازم برای اتخاذ سیاست جنایی را به بحث و بررسی میگذارد. ملزومات سیاستگذاری جنایی در حوزه جرایم دولتی، مشتمل بر «بایسته های سیاست عمومی» و «بایسته های قانونگذاری» است. بر این اساس، لزوم مشروعیّت نظام سیاسی، کاربست ساختار سیاسی قانون محور، مداخلة نهادهای مدنی، نظارت قانون اساسی و فرا قانون اساسی بر عملکرد ارکان دولت، امتناع از توجّه صرف به عقلانیّت سیاسی در فرایند قانونگذاری و توجّه به مقبولیّت و حاکمیّت قوانین، لازمه سیاستگذاری جنایی در عرصه جرایم دولتی است.
