دولت‌ها برای حل گستره متنوعی از مسائل عمومی از سیاستگذاری جنایی استفاده می‌کنند. در صورتی که سیاستگذاری جنایی با شناخت کافی از مسأله انجام نشود و پیش از تحلیل مسأله، راهکار طراحی شود، نه تنها سیاست جنایی در حل مسأله محکوم به شکست است، بلکه هزینه‌های مادی و انسانی قابل توجهی در راستای حل یک مسأله کم اهمیت یا نامسأله هدر می‌رود. فارغ از مدل سیاست جنایی حاکم در کشورها می‌توان با استفاده از برخی شاخص‌ها، وضعیت کلی نظام سیاستگذاری جنایی را از حیث توجه به بایسته‌های مسأله‌محوری تحلیل نمود و با فهم نواقص نظام سیاستگذاری جنایی نسبت به اصلاح آن اقدام نمود. سیاستگذاری جنایی مسأله‌محور دارای بایسته‌های محتوایی و فرآیندی است. در مقاله حاضر با رویکرد توصیفی-تجویزی و با استفاده از منابع کتابخانه‌ای به طراحی چهارچوب کلی تحلیل نظم سیاستگذاری جنایی پرداخته شده است. از منظر محتوایی، نوع شواهد به کارگرفته شده در سیاستگذاری جنایی بر اساس هرم سلسله مراتب شواهد و از نظر فرآیندی، رعایت اصل تفکیک میان مرحله تحلیل سیاستی و پیش‌نویس‌نگاری در چرخه سیاستگذاری جنایی، به عنوان مهم‌ترین بایسته‌های مسأله‌محوری در قالب چهارچوب کلی تحلیل نظام سیاستگذاری جنایی از منظر مسأله محوری ارائه شده است.
