چکیده

در فرآیندِ پیشاواگذاری، واگذاری و پساواگذاری طرح‌های تملک دارایی‌های سرمایه‌ای، محتمل است جرایم و تخلفاتی در قلمرو «بودجه و اعتبارات» و «معاملات دولتی» واقع ‌شود. از این‌رو، مداخله‌ قانونگذارِ کیفری بر مبنای اصل ضرر و جلوگیری از تجاوز به منافع عمومی، توجیه شده است. بدیهی است عدم چاره‌اندیشی درست در مواجهه با این پدیده، پیامدهای بسیار سویی به دنبال خواهد داشت؛ بنابراین، ارزیابی مستمر سیاستگذاری کیفری ضرورت دارد. در این پژوهش، به روش توصیفی-تحلیلی، ماهیت سیاست کیفری از حیث شدت، انسجام و یکپارچگی، روزآمدی قوانین و مقررات و وحدت یا هماهنگی مراجع نظارتی و رسیدگی که از معیارهای یک سیاست کیفری مطلوب است، مورد ارزیابی قرار گرفت. برآیند ارزیابی مذکور، نشان‌دهنده‌ عدم انسجام و یکپارچگی در قانونگذاری و عدم کارآمدی و عدم تناسب پاسخ‌دهی کیفری و نبود وحدت و یا هماهنگی مراجع نظارتی است. از این‌رو، چاره‌اندیشی برای رفع این خلأها ضرورت دارد.
