Structural and Policy Challenges Hindering Iran’s Transition from an Interventionist State to a Regulatory State

Abstract
To enhance efficiency, fundamentally transform governance, reduce direct state involvement in economic activities, and upgrade regulatory functions, some governments have shifted toward a model that accelerates state development. In this new form, the state moves beyond the traditional functions of the past; by redefining legal frameworks and indicators, it adopts a new model of governance. In Iran, the state has attempted to navigate this transition since the 2000s (the 1380s SH), particularly following the issuance of the General Policies of Article 44 of the Constitution—policies designed to elevate the state's supervisory and regulatory roles and strengthen its functional capabilities. However, realizing this process in practice has proven difficult. Analyses reveal that numerous structural and policy-related obstacles have impeded the state's path, leading to institutional gridlock and challenges in implementation. The central question of this article is: What structural and policy factors have caused Iran’s inability to successfully transition from an interventionist state to a regulatory state? Employing a qualitative approach and document analysis, this study concludes that entrenched institutional structures associated with a rentier economy and a lack of independent institutions are among the primary factors hindering this transition. The findings suggest that the effective realization of a regulatory state requires guaranteeing institutional independence, strengthening operational mechanisms, ensuring transparency, reducing reliance on rentier resources, and restructuring political-economic institutions.
