These requirements have specific definitions and concepts which may be different from country to country. On the other hand, according to patent regulations, in certain cases, it is necessary to issue Compulsory licenses for the exploitation of patents, and in some cases, under the category of exceptions to patents, the invention can also be used without the permission of the inventor. However, the issue of climate change, which is now an important international issue, has changed many of the globally accepted infrastructure and principles and regulations. Therefore, considering the importance of patents in the development of countries, the question is whether the phenomenon of climate change can also make changes in the patent system and lead to an increase or decrease in patent issuance? And or in some way, expand the cases of free exploitation of patents? The present paper concludes with a descriptive-analytical method with a library and sometimes field research that changes in the components of the patent system and new interpretations of its regulations are not unlikely considering climate change and environmental hazards and signs of this change can be found.}, keywords = {Three steps,climate change,Patent,Intellectual Property,compulsory license}, title_fa = {بازخوانی سیاست‌ها و قواعد نظام حق اختراع در پرتو مسئله تغییر اقلیم}, abstract_fa = {اختراعات براساس مؤلفه‌های سه‌گانه تازگی، ابتکاری بودن و کاربرد صنعتی، ثبت و حمایت می‌شوند. این مؤلفه‌ها دارای تعاریف و مفاهیم خاصی بوده که بعضاً از تنوع در نظام‌های ملی برخوردار است. از سویی، به موجب مقررات مربوطه، می‌توان در برخی موارد خاص و ضروری به صدور مجوز اجباری بهره‌برداری از اختراعات اقدام نمود و در بعضی موارد تحت مقوله استثنائات وارد برحق اختراع، نیز بدون اجازه مخترع از اختراع وی استفاده کرد. با وجود این، مسئله تغییر اقلیم که اکنون از موضوعات مهم بین‌المللی است بسیاری از زیرساخت‌ها و اصول و ضوابط پذیرفته شده جهانی از جمله نظام حق اختراع را دستخوش تغییر کرده است. از این رو، با عنایت به اهمیت ثبت اختراعات در توسعه کشورها این پرسش مطرح است که آیا پدیده تغییر اقلیم می‌تواند در نظام حق اختراع نیز تغییراتی را ایجاد کند و منجر به افزایش یا کاهش صدور گواهینامه شود و از سویی موارد بهره‌برداری آزاد از اختراعات را گسترش دهد؟ مقاله حاضر با روش توصیفی تحلیلی و با رویکرد کتابخانه‌ای و بعضاً میدانی سرانجام به این نتیجه می‌رسد که تغییر در مؤلفه‌های نظام حق اختراع و ارائه تفاسیر جدید از مقررات آن با ملاحظه مسئله تغییر اقلیم و مخاطرات زیست محیطی بعید نیست و می‌توان نشانه‌های این تغییر را دریافت.}, keywords_fa = {Three steps,climate change,Patent,Intellectual Property,compulsory license}, url = {https://jppolicy.ut.ac.ir/article_81995.html}, eprint = {https://jppolicy.ut.ac.ir/article_81995_2c8f9eb7ef5249b8a426e502ca7b96aa.pdf} }
